Welcome to Flow. These Terms of Service (“Terms”) govern your access to and use of the Flow website, products, and services (collectively, the “Services”). By creating an account or using our Services, you agree to be bound by these Terms.
1. Your account
To use Flow you must create an account and provide accurate, current information — including the email address we use to reach you about your website. Keep it up to date.
You are responsible for safeguarding access to your account and for all activity that occurs under it. Flow signs you in with one-time codes and passkeys rather than passwords; treat sign-in links and codes like keys and notify us immediately if you believe your account has been accessed without your permission.
You must be at least 18 years old, or the age of majority where you live, to create an account.
2. Your subscription and trial
Flow is a paid subscription. We offer a free trial that requires a valid payment method to start. At the end of the trial your subscription begins and your payment method is charged automatically, unless you cancel before the trial ends.
Subscription fees are billed in advance on a recurring monthly basis. Prices are shown at checkout; we will give you advance notice before any price change takes effect on your plan.
You can cancel at any time. Cancellation takes effect at the end of the current billing period, and your website is taken offline afterward. We do not provide refunds or credits for partial billing periods.
3. Your content
You retain all rights in the content you provide to Flow — your business details, text, and photos (“Your Content”). By providing it you grant Flow a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to provide and improve the Services.
Flow also generates website content for you — layouts, copy, and design. Once published to your website, that generated content is yours to use as part of your site for as long as you maintain an account. Stock photography placed on your site remains licensed from its providers and may not be extracted and resold on its own.
You are responsible for Your Content and represent that you have all rights necessary to use it and to grant the license above. We recommend keeping your own copies of anything you upload; we are not liable for loss of Your Content.
4. Acceptable use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:
- in any way that violates applicable law or regulation;
- to infringe, misappropriate, or violate the rights of others;
- to upload or transmit malware or other harmful code;
- to attempt to gain unauthorized access to our systems or other users' accounts or websites;
- to send spam or other unsolicited communications from your website;
- to interfere with or disrupt the integrity or performance of the Services.
We may suspend or terminate access to the Services for any violation of these Terms.
5. Third-party services
The Services rely on third-party providers — for example payment processing (Stripe), stock photography, mapping and geocoding, and email delivery. Your use of features backed by those providers is also subject to their terms.
Your website may link to or embed third-party content. Flow does not control and is not responsible for third-party websites or services.
6. Fees and payments
Payments are processed by Stripe; Flow does not store your full card details. By subscribing you authorize us to charge your payment method for your plan's recurring fees and any applicable taxes.
If a payment fails we may retry it and notify you. If payment cannot be collected after reasonable attempts, we may suspend or cancel your subscription and take your website offline.
7. Termination
You may stop using the Services and cancel at any time. We may suspend or terminate the Services or your account if you materially breach these Terms, if required by law, or if we discontinue the Services (in which case we will give you reasonable notice).
Upon termination your website is taken offline. Sections of these Terms that by their nature should survive termination (including Your Content license for past hosting, disclaimers, and limitations of liability) survive.
8. Accessibility
We want Flow to work well for everyone and we make ongoing efforts to improve the accessibility of our website and the websites we generate. That said, by using the Services you acknowledge and agree that the Flow website and the websites it generates may not conform to every accessibility standard or guideline, including all provisions of the Web Content Accessibility Guidelines (WCAG) or the Americans with Disabilities Act (ADA), and are provided on an “as is” and “as available” basis with respect to accessibility.
If you encounter an accessibility barrier or need a specific accommodation, please tell us by submitting a request through our contact page, describing the issue and the page or feature involved. We will review reasonable requests and make good-faith efforts to address them, but we do not guarantee that any particular barrier will be resolved within a specific timeframe.
To the fullest extent permitted by law, nothing in the Services constitutes a representation or warranty that the Services comply with any specific accessibility law, standard, or guideline, and your use of the Services is subject to the disclaimers and limitations of liability in these Terms.
9. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Flow disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Website content is generated in part by automated systems. You are responsible for reviewing your website — including business details, pricing, and claims — before and after publishing. We do not warrant that the Services will be uninterrupted, error-free, or that generated content will be accurate or suitable for your purposes.
10. Limitation of liability
To the fullest extent permitted by law, Flow will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to the Services.
To the fullest extent permitted by law, Flow's total liability for all claims arising out of or relating to the Services will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold Flow harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your website, or your violation of these Terms or applicable law.
12. Changes to these terms
We may update these Terms from time to time. If we make material changes we will notify you — for example by email or a notice in the product — before they take effect. Continuing to use the Services after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.
